FOUNTAIN RENTAL INFORMATION: Client agrees to rent chocolate fountain from Black Pelican Catering. (Rental fee $ 395.00 + 8 % sales tax). Client agrees to purchase any additional chocolate at $0.50 per person for over 200 guests. When feasible, client requests made on the day of the event for extended use of the chocolate fountain will be accommodated depending on our availability. Payment of overtime requests must be paid at the time of request. Client agrees to purchase additional fountain time of desired at $25.00 per 1/2 hour. CHOCOLATE: Only chocolate provided by Black Pelican Catering. will be used in the fountain. All chocolate must be purchased from us. There are no refunds for unused chocolate. INCLUDED: Delivery of fountain, set up tear down and cleaning of the chocolate fountain,500 skewers, 3 hours of operating time (Start time as stated above),Chocolate fountain attendant,chocolate for 25 to 200 guests. YOU AGREE TO PROVIDE:
Room for attendants to stand behind table.
OPTIONAL: Dipping items can be provided by you, or we can provide an assortment of dipping items starting at $4.00 per guest. Rental Agreement General Provisions PAYMENT TERMS: A $200.00 non-refundable deposit is required to reserve Black Pelican Catering Chocolate Fountain. To confirm this agreement, return one signed and completed copy of this contract along with the $200.00 deposit within 5 days of the reservation. In the event the signed contract is not returned, payment of the deposit shall be deemed full approval, acceptance and agreement to the terms and conditions contained in this contract. The balance is due NO LATER than 14 days prior to the event and can be paid by credit card or check. ($50.00 fee for all returned checks.) Once the balance is paid, no refund shall be made. Make checks payable to Black Pelican. If the balance is not received within 14 days prior to the date of the event, Black Pelican Catering receives the right to deem this agreement canceled by client. CANCELLATION: This agreement can not be canceled, except in writing no later than 14 days prior to the event or when the final payment is received, whichever is sooner, by either the Client or Black Pelican Catering. In the event product has been ordered for the event, Client agrees to reimburse for the costs of same. If the Client initiates the cancellation, Black Pelican Catering. will retain the non-refundable deposit paid at time of reservation. Client will hold harmless Black Pelican Catering in the event of illness, injury, act of God or any other situation beyond the control of Black Pelican Catering, that prevents Black Pelican Catering from performing. In the event Black Pelican Catering must cancel the reservation for any reason, Client shall be entitled to full return of deposit, and upon such tender of the deposit, shall constitute a complete release of Black Pelican Catering from all claims of liability or damage by Client. PROVISIONS: Black Pelican Catering requires access to the desired set-up area at least 1 hour prior to the start time. In addition, 45 minutes are required after the conclusion of the service period for take down and removal. Black Pelican Catering also requires at least 1 120-volt circuit within 10 feet of the desired set-up area that adheres to contemporary safety standards and supplies at least 15 amps. Client covenants and agrees to accept full responsibility and liability for any damages, injuries or delays that occur as a result of client's failure to comply with any provisions as contained within this agreement LIABILITY: Client warrants, covenants and agrees to protect, defend and indemnify and hold Black Pelican Catering harmless from and against any and all claims, damages, liabilities or expenses arising out of or from (i) the use of the chocolate fountain, (ii) the consumption of chocolate by Client or any person at the event, (iii) any breach or default in the performance of any obligation of Client, licensees, employees, or any of their respective agents, employees and contractors. Black Pelican Catering shall not be liable for any damages to or loss of Client's personal property, or for any personal injury, from any cause whatsoever as set forth above. Client agrees to indemnify and save harmless Black Pelican Catering from any and all claims, damages, liabilities or expenses including reasonable attorney's fees.
